Analisis Implementasi Sistem Sponsorship (Kafala) terhadap Pelanggaran Hak Pekerja Migran Indonesia di Saudia Arabia

The purpose of this writing is to analyze why kafala work system implemented by Saudi Arabia is causing a violation of the rights of Indonesian migrant workers. The research uses the human security theory as personal security and legal protection and some concepts such as human rights, migrant workers, kafala system, development migration to answer the problem formulation because all of them are able to explain the violation of the rights to migrant workers caused by kafala system. The complaints and cases experienced by Indonesian migrant workers each year are largely done by their employers (sponsorship). The research uses a qualitative-descriptive approach, with data sourced from primary and secondary sources. The data collected follow the reduction technique of Miles and Hubermann. The research found that kafala system implemented by Saudi Arabia bears some similarity to the ancient culture of slavery on the Arab Peninsula. In addition, the factors that cause kafala system to provoke rights are the states’ explosive policy, explosive working conditions, and explosive living condition. The study also found the fact that implementation of the syariqah system it is hoped to shut down the kafala system on its application still using the kafala system.
